  1. OVERVIEW

This website is operated by TCMA Moto. Throughout these Terms of Service, “TCMA Moto”, “we”, “us” and “our” refer to TCMA Moto.

These Terms apply when you visit tcmamoto.com, purchase a product or otherwise use our website or services. By using the website or placing an order, you agree to these Terms and our related policies.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

  1. ONLINE STORE

You must provide accurate and complete information when placing an order. You are responsible for checking your contact information, delivery address, phone model and selected product variant before completing checkout.

You must not use our website or products for any unlawful purpose or attempt to interfere with the operation or security of the website.

  1. PRODUCT INFORMATION

We take reasonable care to describe and display our products accurately. Product photographs are provided as a guide, and minor variations may occur because products are made to order.

Unless otherwise stated, TCMA phone holders are supplied in black.

Our phone holders are designed for specific phone models. You must select the correct phone model before ordering. If your phone model is not listed or you are unsure which option to select, contact us before placing your order.

Bike compatibility depends on the handlebar diameter, taper and available space at the intended mounting position. The holders are designed for many full-size dirt bikes fitted with 28/22 mm oversized tapered aluminium handlebars, but a reference to a motorcycle brand or model does not guarantee fitment to every model year, handlebar or modified motorcycle.

If you are unsure about bike fitment, email admin@tcmamoto.com with the motorcycle make, model, year and a clear photograph of the handlebars before ordering.

  1. MADE-TO-ORDER PRODUCTS

TCMA phone holders are made to order on the NSW South Coast. Production normally takes between 3 and 7 business days before dispatch or collection.

Production times are estimates and may vary due to order volume, material availability or circumstances outside our reasonable control. We will contact you if we expect a significant delay.

If you need to cancel or change an order, contact us as soon as possible. Once production has started, we may be unable to accept a cancellation or change-of-mind return. This does not affect your rights regarding faulty, damaged, incorrect or misdescribed products.

  1. PRICES AND PAYMENT

All prices displayed on the website are in Australian dollars unless otherwise stated.

The price charged is the price displayed at checkout when the order is placed, including any applicable discount. Shipping or delivery charges are shown separately before payment.

Payment must be successfully authorised before we begin processing an order.

We may correct genuine pricing, product or inventory errors. If an error affects an order already placed, we will contact you and give you the option of proceeding on the corrected basis or receiving a full refund.

  1. ORDERS AND AVAILABILITY

Receiving an order confirmation does not mean that we have accepted an order that contains an obvious pricing error, suspected fraud or a product we cannot reasonably supply.

If we cannot fulfil your order, we will contact you and provide a refund for the affected product.

We may reasonably limit or refuse an order where necessary to prevent fraud, address an obvious error or comply with the law. We will not cancel an accepted order arbitrarily.

  1. SHIPPING, LOCAL DELIVERY AND PICKUP

Our processing times, shipping rates, delivery estimates, local delivery areas and pickup arrangements are set out in our Shipping Policy:

Delivery timeframes are estimates and consist of our production time plus the carrier’s transit time. Express Post shortens the postal transit time but does not shorten the made-to-order production period.

Customers are responsible for providing a complete and accurate delivery address. Contact us immediately if an address needs to be corrected. We cannot guarantee that an address can be changed after dispatch.

Free local delivery is available only for eligible postcodes shown at checkout. Free local pickup is available from the nominated Ulladulla pickup location once you have received confirmation that your order is ready.

  1. WIRELESS CHARGING

A wireless charging pad is included with the holder. A suitable USB power source or motorcycle power adaptor is required and is not included.

Wireless charging requires a compatible phone. Charging performance may be affected by the phone model, case thickness, power supply, cable, temperature and riding conditions.

Customers must ensure that electrical connections and power supplies are suitable, securely installed and protected from damage. If you are unsure about motorcycle wiring, obtain assistance from a suitably qualified person.

  1. INSTALLATION AND SAFE USE

Motorcycle riding, particularly off-road riding, involves inherent risks. The TCMA holder is an accessory and does not remove those risks.

You are responsible for correctly installing the product, tightening all fasteners and checking the holder, phone and charging components before each ride. Stop using the product if it becomes loose, damaged or excessively worn.

The holder must not obstruct motorcycle controls, cables, instruments or the rider’s view. Do not operate or adjust a phone while riding where doing so would be unsafe or unlawful.

Damage caused by a crash, accident, misuse, incorrect installation, unauthorised modification or normal wear and tear is not considered a manufacturing fault. This does not limit any rights you may have under the Australian Consumer Law.

  1. RETURNS, REFUNDS AND CONSUMER GUARANTEES

Our products come with consumer guarantees under the Australian Consumer Law. Depending on the nature of a problem, customers may be entitled to a repair, replacement, refund or compensation.

Nothing in these Terms or our policies limits any consumer guarantee or other right that cannot lawfully be excluded.

  1. WEBSITE CONTENT AND AVAILABILITY

We aim to keep the website accurate and available, but temporary interruptions, technical issues or genuine errors may occur.

We may update product information, availability and website content when reasonably required. Changes will not remove rights that have already arisen under an accepted order.

  1. THIRD-PARTY SERVICES

Our store is hosted by Shopify, and payments, shipping and other functions may be provided by third parties. Your use of those services may also be governed by the relevant provider’s terms and privacy practices.

Links to third-party websites are provided for convenience. TCMA Moto does not control those websites and is not responsible for their independent content or practices.

  1. INTELLECTUAL PROPERTY

The TCMA Moto name, branding, product designs, photographs, videos, written content and other materials on this website are owned by or licensed to TCMA Moto.

You may view the website and share links for personal, non-commercial purposes. You must not copy, reproduce, manufacture from, commercially exploit or misrepresent our content or product designs without written permission.

  1. PRIVACY

We handle personal information in accordance with our Privacy Policy:

  1. LIABILITY

To the extent permitted by law, TCMA Moto is not responsible for loss or damage caused by misuse, incorrect installation, unauthorised modification, accidents or use contrary to supplied instructions.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising under the Australian Consumer Law.

  1. CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our products, website, business practices or legal obligations.

Updated Terms will be published on this website with a revised date. Changes apply prospectively and do not remove rights arising from orders placed before the change.

  1. SEVERABILITY

If any part of these Terms is found to be invalid or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining Terms will continue to apply.

  1. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.

Nothing in this section restricts any right a consumer may have to bring a claim in another jurisdiction under applicable consumer law.
